NOTICE OF REFUSAL
CONCERNING PROPOSED OFFICIAL PLAN AND ZONING BY-LAW AMENDMENTS

TAKE NOTICE that the Council of the Corporation of the Municipality of Central Elgin, as approval authority, refused proposed amendments to the Municipality of Central Elgin Official Plan the Township of Yarmouth Zoning By-law 1998 pursuant to Section 22 (6.6) and Section 34(10.9) of the Planning Act, R. S. O., 1990, as amended.
The subject lands are located on the west side of Quaker Road, south of Roberts Line, have approximately 80.5 metres (264.1 feet) of frontage and are approximately 1.98 hectares (4.89 acres) in lot area (see Key Map). Municipally known as 5277 Quaker Road, they may be legally described as Concession 2, North Part Lot 21, Municipality of Central Elgin.
The purpose of the Official Plan and Zoning By-law amendments are to permit a rural wedding/event venue use on the subject lands. The effect of the Official Plan amendment is to provide a site-specific exception to the “Agricultural” designation on the property to include a “Rural Wedding / Event Venue” as a permitted use. Further, the effect of the zoning by-law amendment is to provide an additional permitted use being a “Rural Wedding / Event Venue” use to the site-specific Open Space Zone 1 (OS1) zone, recognize the location of the existing buildings and structures on the property, and provide a maximum occupancy and parking requirements for the additional permitted use.
A public meeting was held on June 26, 2023. At that meeting, the applicant’s agent presented information to support the proposed development and comments were provided by Staff. No comments were received from the public. Concerns were raised with respect to parking and servicing for the proposed use.
The Council of the Municipality of Central Elgin refused the proposed amendments to the Municipality of Central Elgin Official Plan and the Township of Yarmouth By-law No. 1998. The reasons for refusal were that the Council of the Corporation of the Municipality of Central Elgin did not support passing By-law No. 2797 and 2798, respectively, as Council did not believe that they were consistent with the policies of the 2020 Provincial Policy Statement and did not conform to the policies of the County of Elgin Official Plan, and the Municipality of Central Elgin Official Plan.
TAKE NOTICE that a person or public body that requested an amendment to the Official Plan or Zoning By-law of the Corporation of the Municipality of Central Elgin may appeal the refusal of the requested amendment to the Ontario Land Tribunal in respect or all or any part of the requested amendment by filing a notice of appeal with the Clerk of the Municipality of Central Elgin.
AND TAKE NOTICE the decision of the Municipality of Central Elgin is final if a notice of appeal is not received on or before July 21, 2023.
No person or public body shall be added as a party to the hearing of the appeal unless, before the requested zoning by-law amendment was refused, the person or public body made oral submissions at a public meeting, if any, or written submission to the council, or in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
